Payments and Refund Policy
General
The sellers are responsible for the payment of all direct or indirect taxes, including GST, VAT, or income taxes, that may be required in accordance with the laws of their jurisdiction. Sellers guarantee and affirm their compliance with local income tax laws and their ongoing commitment to fulfill their tax obligations. The price displayed on either the offer page or the order page includes all applicable taxes and fees payable by the sellers.
Yoo-loo is designated by the sellers as their authorized payment collection agent with limited authority. Yoo-loo's sole responsibility is to receive payments from buyers (via its Payment Services Provider, if applicable) and transmit those payments to the sellers. The sellers acknowledge that payments made to Yoo-loo by buyers will be treated on par with payments made directly to the sellers. Once Yoo-loo (or its Payment Services Provider, if applicable) receives the payment, the buyer's obligation to the seller will be fulfilled. Yoo-loo (via its Payment Services Provider, if applicable) is responsible for transferring the funds to the seller in accordance with the specified payment terms. The seller agrees that Yoo-loo may incorporate the terms outlined here into any relevant terms of service, receipts, disclosures, or notices, including receipts provided to buyers, as deemed necessary or advisable by Yoo-loo.
Yoo-loo collaborates with Payment Services Providers to facilitate payment collection from buyers, transfer such payments from buyers to sellers, and hold funds associated with Yoo-loo Balances. All payment services related to fund withdrawals on the Yoo-loo platform are performed exclusively by Yoo-loo Payment Services Providers..
Purchasing
Genera
Buyers pay Yoo-loo to create a purchase from assets listed by the Sellers. Yoo-loo partners with Payment Services Providers for purposes of:
- collecting all payments from Buyers
- transferring such payments from Buyers to Sellers, and
- holding funds in connection with Yoo-loo Balances.
Yoo-loo acts as a limited authorized payment collection agent for the seller, with the sole purpose of accepting payments from the buyer (via its Payment Services Provider, if applicable) and transmitting those payments to the seller. The buyer's payment obligation to the seller will be fulfilled upon Yoo-loo (or its Payment Services Provider, if applicable) receiving the payment, and it is the responsibility of Yoo-loo (via its Payment Services Provider, if applicable) to remit the funds to the seller in accordance with the specified payment terms. Should Yoo-loo (via the Payment Services Provider) fail to remit any such amounts to the seller, the seller will have recourse solely against Yoo-loo and not against the buyer directly.
In most locations, purchases on Yoo-loo can be made using a credit card or an existing Yoo-loo balance. Additional payment methods may be available in specific locations.Your existing Yoo-loo Balance will be automatically applied to your next purchase.
Sellers are strictly prohibited from offering or accepting payments through any means other than the Yoo-loo site. If sellers receive requests to use alternative payment methods, they should immediately report it to Customer Support.
In order to prevent fraud, unauthorized transactions (including money laundering), claims, or other liabilities, Yoo-loo or Yoo-loo Payment Services Providers collect payment information for the purpose of processing withdrawal payments. Payment Services Providers may also collect additional necessary information for processing such payments. Yoo-loo is not exposed to the payment information provided to Payment Services Providers, and the handling of this information is governed by the privacy policy of the respective Payment Service Provider. By utilizing any payment method and/or providing payment details for purchases on Yoo-loo, you confirm and warrant that: (a) you have the legal authorization to provide such information; (b) you have the legal authority or permission to make payments using the selected payment method(s); (c) if you are an employee or agent acting on behalf of a company or individual who owns the payment method, you have the authorization from that company or individual to use the payment method for transactions on Yoo-loo; and (d) such actions are in compliance with all applicable laws.
Local Currencies
Yoo-loo offers the option to pay in multiple currencies. Prices are rounded up to the nearest whole number for convenience, and the accurate amount to be paid will be displayed at checkout. Unless specified otherwise, the payment will be charged in the currency shown on the payment page. Currency exchange services for payments in local currencies are handled by Yoo-loo Payment Services Providers.
Please note that all prices on Yoo-loo are originally derived from USD$. Therefore, non-USD$ currency prices may fluctuate daily due to exchange rate changes and may include conversion fees. Buyers always have the flexibility to pay in USD$ by adjusting their currency preference.
If an order is paid in a currency other than USD$ and is subsequently cancelled, the amount refunded to the Yoo-loo Balance will be based on the exchange rate at the time of cancellation. Therefore, the refunded amount may differ from the original payment in terms of the local currency value, while maintaining the same value in USD$.
The Yoo-loo Balance is always denominated in USD$, even if it is displayed in a non-USD$ currency. Consequently, if users choose to view their Yoo-loo Balance in a currency other than USD$, it may fluctuate daily due to exchange rate variations, while maintaining the same value in USD$. Users always have the option to switch their displayed currency to USD$ to view their Yoo-loo Balance.
Disputes and Cancellations
We encourage our Buyers and Sellers to try and settle conflicts amongst themselves. If for any reason this fails after using the Resolution Center or if you encounter non-permitted usage on the Site, users can contact Yoo-loo Customer Support department for assistance.
Order Cancellations
Yoo-loo encourages Buyers and Sellers to resolve service disputes mutually using the Resolution Center.
Eligibility for requests to Yoo-loo to cancel an order will be assessed by Yoo-loo based on a number of factors, including violations of our Terms of Service and/or our Community Standards, general misconduct, and improper usage of the Yoo-loo delivery system.
Purchases are not eligible to be cancelled based on the quality of service/materials delivered by the Seller if the service was rendered as described in the offer Page. You may rate your experience with the Seller on the Order Page, including the overall level of service quality received.
You must use Yoo-loo Resolution Center to address your concerns and desired resolution related to the service provided by their Seller prior to contacting Customer Support. Customer Support will not take any action against Orders where the applicant has failed to inform their Seller of issues related to the Seller’s service and will allow Sellers to provide a resolution first. This does not include non-permitted usage of Yoo-loo.
Any non-permitted usage of Yoo-loo encountered during an Order, after being reviewed by our Customer Support team, may result in the order being cancelled. This includes, but is not limited to; harassment, unlawful behaviour, or other violations of Yoo-loo Terms of Service.
Chargebacks
Yoo-loo assumes the responsibility of reviewing cases involving payment provider chargebacks and disputes on behalf of sellers. While the outcome of each case may vary depending on the reason for the chargeback, our team works diligently to resolve disputes in favor of the sellers. If permitted by the chargeback case, Yoo-loo (or one of its Payment Services Providers) will refund a portion or the entire revenue back to the sellers. However, if the chargeback is not resolved in the seller's favor, the seller will be responsible for the chargeback amount.
Initiating a transaction dispute or reversing a payment through your payment provider or bank is considered a violation of these Payment Terms. Such actions may result in temporary or permanent account disablement. It's important to note that once a dispute has been filed with the payment provider, the funds become ineligible for refund due to our obligations to the payment provider.
If you encounter any issues related to the service provided in an order, we encourage you to utilize the dispute resolution tools available on the site to attempt to resolve the matter.
Yoo-loo, in conjunction with its Payment Services Provider, reserves the right to cancel orders or place funds on hold in the event of suspected fraudulent transactions occurring on the site.
The transfer and assignment of intellectual property to the buyer are contingent upon full payment, and the delivery of the intellectual property may not be used if the payment is cancelled for any reason.
Refunds
Yoo-loo does not automatically refund payments made for cancelled orders back to your payment provider. Funds from order cancellations are returned to the Buyer's Yoo-loo Balance and are available for future purchases on Yoo-loo.
Purchase refunds (i.e. refunds directly to your payment provider) can be requested through our Customer Support team, based on the purchase’s original payment amount and currency. To prevent fraud and abuse, we limit the total amount of times users can request a payment provider refund, which is subject to review by our Customer Support team. Such refunds may be subject to an additional fee.
Please note, that the Customer Support team has the right to decline a refund request if one or all the following criteria are met:
- The user is no longer an active Yoo-loo user due to Terms of Service violations or the closure of their account;
- User is abusive towards the other party through threats of low ratings or leveraging order materials (such as logins, and personal information) against each other;
- We believe that account has been used for illegal or harmful actions;
- Service was successfully delivered to the User (user was able to download the image).
Modifications
Yoo-loo may make changes to these Payment Terms from time to time. When these changes are made, Yoo-loo will make a new copy of the terms available on this page.
You understand and agree that if you use Yoo-loo after the date on which the Payment Terms have changed, Yoo-loo will treat your use as acceptance of the updated Payment Terms.
